On Nov. 15, the Ministry of culture and tourism issued the regulations on credit management of culture and tourism market (hereinafter referred to as the "Regulations"), which shall come into force as of January 1, 2022.
According to the regulations, if a travel agency is identified as a serious dishonest subject due to the revocation of its business operation license, its main person in charge shall not serve as the main person in charge of any travel agency within five years; if a tour guide or tour leader is identified as a serious dishonest subject due to the revocation of its tour guide license, the relevant management personnel of the travel agency shall be identified as a serious dishonest subject due to the revocation of its business operation license Those who are seriously dishonest shall not re apply for a tour guide certificate or engage in travel agency business within 3 years from the date of punishment; if a travel agency is identified as a serious dishonest subject due to an administrative penalty of more than a fine for infringing on the legitimate rights and interests of tourists, it shall not apply for outbound tourism business within 2 years from the date of punishment.
It is understood that the regulation is applicable to the collection, collection, publicity and sharing of credit information of cultural and tourism market subjects and practitioners, Credit Incentive and punishment for dishonesty, credit restoration, credit commitment and credit evaluation and other activities. Among them, the main body of the tourism market includes legal persons or other organizations engaged in the business services of travel agencies, class a tourism scenic spots, tourism accommodation and online travel; the practitioners include the legal representative, main responsible person, actual controller, tour guide and other relevant personnel of the above market main body.
